CK Chemistry — Terms and Conditions for Tuition Services

1. Who these terms apply to

These terms form the contract between Claire Costello-Kelly, trading as CK Chemistry, of [trading address] (“we”, “us”, “CK Chemistry”), and the person who books or pays for tuition (“you”). Where a student is under 18, “you” means the parent or guardian who books and pays, and by booking you confirm you have parental responsibility and are authorising the student named on the booking to take part. Where a student is 18 or over and booking for themselves, “you” means that student directly.

2. Our services

We provide A Level chemistry tuition, comprising:

Group masterclass programme — live sessions delivered via Zoom, cameras and microphones off, participation via text chat, capped group sizes, running broadly September to June with monthly assessments (“mini mocks”);
Regular one-to-one tuition — a recurring weekly slot, booked on an ongoing basis and delivered via Zoom;
Ad-hoc one-to-one sessions — occasional, one-off sessions delivered via Zoom, currently offered to students already enrolled on the group programme, subject to a slot being available that week;
Related resources provided as part of a programme (e.g. session recordings, worksheets, feedback on assessments).

3. Marking, feedback, homework and predicted grades

3.1 Group masterclass programme

The PLUS tier of the group masterclass programme includes one assessment marked by us, with written feedback, each month as part of the mini-mock cycle described in Section 2. This is the marking and feedback included as standard; anything beyond this — for example, an additional past paper marked outside the monthly assessment — is only provided where agreed and paid for separately.

3.2 One-to-one tuition (regular weekly slots and ad hoc sessions)

Whether a one-to-one session is a regular weekly slot or booked ad hoc, we are happy to set homework or extra revision activities between sessions where useful. As standard, this work is either self-marked by the student, using a mark scheme or model answer we provide, or reviewed together within a lesson — it is not marked or given written feedback by us outside of the lesson itself. If you would like a full assessment or past paper marked with written feedback, a mock exam marked, or another piece of work reviewed outside a lesson, this can be arranged as a one-off, paid separately from your regular session fees — please ask and we will confirm cost and turnaround beforehand.

3.3 Predicted grades and references

We do not provide predicted grades, exam references, or UCAS predictions as a standard part of any tuition package, and cannot do so at short notice. Where we agree, to provide a predicted grade for a student, this is offered at our discretion and only once we have enough evidence of current performance to support it — as a guide, at least five assessments that we have set and marked ourselves (not past papers or questions for which mark schemes are already publicly available), completed within a reasonable period before the grade is needed. A predicted grade given on this basis reflects our professional judgement based on that evidence; it is not a guarantee of exam performance, and should not be relied upon as a formal school or college reference.

4. Booking and forming a contract

A contract is formed, and these terms take effect, when we confirm your booking or accept your first payment, whichever is earlier. We reserve the right to decline or withdraw a booking at our discretion (for example where a group is full, or where we reasonably consider the arrangement unsuitable), in which case any payment already made will be refunded in full.

5. Fees and payment

Group programme fees are billed on a rolling monthly basis with no fixed-term commitment, at the rate shown for the relevant tier and year group at the time of booking.
Regular weekly one-to-one slots are billed at the published hourly rate, payable in advance unless otherwise agreed in writing.
Ad-hoc one-to-one sessions are booked and paid for in a single step through our online scheduling and payment system; see Section 6.3 for how cancellations and refunds work for these.
We may change our prices from time to time. For existing group enrolments, we will give at least 60 days’ notice of any price change before it takes effect; you may cancel before the new price applies with no penalty.
Group programme access — live sessions, recordings and resource materials — is managed automatically through our booking and learning platform and depends on your subscription payment staying up to date. If a renewal payment fails, the platform automatically emails you to let you know; if payment is not then successfully completed, access is automatically suspended until the outstanding balance is paid. This happens as a function of how the platform works, not as a case-by-case decision on our part, so please keep your payment details current to avoid any interruption.
For one-to-one sessions and any other invoiced fees, payment is due by the date shown on our invoice. We reserve the right to suspend access to further sessions where payment is overdue, following at least one reminder from us.

6. Cancellation, notice and refunds

6.1 Group masterclass programme

Because places are billed monthly with no fixed-term commitment, you may cancel at any time via your account dashboard on our learning platform, before your next billing date. Cancellation takes effect at the end of the billing period already paid for — your access continues until then, but you will not be billed again once you’ve cancelled. We do not offer refunds for partially used months. If you have any trouble cancelling through your dashboard, or would prefer us to do it for you, contact us: claire@ckchemistry.co.uk and we’ll action it as quickly as possible.

6.2 Regular weekly one-to-one slots

If you need to cancel or move a booked session, please give at least 48 hours’ notice. Sessions cancelled with less notice than this (or missed without notice) are charged in full, except where we agree otherwise at our discretion (for example, genuine emergencies).

Regular slots are held for you on an ongoing basis, which means we turn away other students who might otherwise use that time. If a slot is cancelled or rescheduled repeatedly — for example, three or more times within any rolling 8-week period — even where proper notice is given each time, we may need to release the slot so it can be offered to someone else. If this becomes a concern, we’ll raise it with you directly first; if the pattern continues, we’ll give you at least two weeks’ notice before releasing the slot, so you have time to make other arrangements.

6.3 Ad-hoc one-to-one sessions

Ad-hoc sessions are offered, subject to availability, to students currently enrolled on our group programme, as a way to make use of additional slots outside the regular timetable. They are booked and paid for directly through our online scheduling and payment system at the time of booking. Booking an ad-hoc session doesn’t create any ongoing commitment on either side — we don’t guarantee a particular slot will be available again, and you’re not obliged to book again.

If you cancel at least 48 hours before the scheduled session, you’ll receive a full refund. Cancellations made less than 48 hours before the session, or sessions missed without cancelling, are non-refundable.

6.4 Cancellations by us

If we need to cancel a session or, exceptionally, end a group programme early, we will give as much notice as reasonably possible and will refund any fees already paid for sessions that did not take place.

7. Conduct, attendance and the learning environment

Group sessions run with cameras and microphones off; participation is via text chat, moderated by us. We may mute, remove, or restrict a student’s access to chat if their conduct is disruptive, disrespectful to others, or breaches this policy.
Students are expected to engage respectfully with tutors and other students, and not to share session links, recordings, or chat content with anyone outside the programme.
Repeated conduct issues may, after we have raised this with you, lead to us ending the arrangement under Section 11.

8. Session recordings

Group sessions are recorded so that enrolled students can revisit content (and so Year 13 students can access relevant Year 12 sessions). Recordings capture only the tutor’s screen-share and voice; students take part with cameras and microphones off, and we do not include chat content, participant names, or individual student work in what we record. Recordings are accessible to currently enrolled students via our learning platform for [the current academic year].

Because recordings made this way do not identify or relate to any individual student, we may retain them beyond this period and reuse them — for example, editing excerpts into resource bank materials or other resources we sell or publish. Any part of a recording that does capture something identifying (for example, if chat content or a student’s own work were ever visible) is not retained beyond the current academic year and is not reused elsewhere.

One-to-one sessions are not recorded by default, but can be recorded on request. Recordings are then shared only with the student/parent via a link to Zoom cloud recordings. These will be made available for 30 days after the lesson and may be downloaded by the student for personal use.

9. Intellectual property in our materials

All teaching materials, worksheets, mini-mock assessments and feedback, session recordings, and resource bank content that we provide as part of tuition remain the copyright of CK Chemistry (or our licensors). Booking tuition gives you and the enrolled student a personal, non-transferable licence to use these materials for that student’s own study — it does not transfer ownership, and does not permit copying, reselling, redistributing, or posting these materials anywhere else, including to other students, tutors, schools, or file-sharing sites and marketplaces. We take copyright infringement seriously and will act on it — see our approach to unauthorised use in Section 13.

10. Safeguarding and under-18 students

Where a student is under 18, our approach to keeping them safe during tuition — including how sessions are structured, how we handle concerns, and who to contact — is set out in our separate Safeguarding Policy, available on request and on our website. By booking on behalf of a student under 18, you confirm you have seen or been offered this policy.

11. Ending the arrangement

In addition to cancellation under Section 6, we may suspend or end tuition, with notice where practicable, if: fees remain unpaid after a reminder; a student’s conduct breaches Section 7 and continues after we have raised it with you; or we reasonably believe continuing the arrangement would raise a safeguarding concern. Where we end an arrangement other than for unpaid fees or conduct, we will refund any fees paid for sessions that have not yet taken place.

12. Liability

We provide tuition and resources with reasonable care and skill, drawing on qualified teaching and examining experience, but we do not guarantee any particular grade or exam outcome — a student’s result depends on many factors beyond our tuition. Nothing in these terms limits or excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited or excluded. Subject to that, our total liability to you in connection with tuition is limited to the fees you have paid us in the 12 months before the claim arose.

13. Copyright, misuse and enforcement

If we become aware that our materials, recordings, or resources have been copied, shared, or redistributed outside the terms of this licence, we will treat this as a breach of contract and, separately, as copyright infringement, and may take action including withdrawing access, contacting the platform hosting the material, and pursuing legal remedies. Our general approach to protecting and enforcing our copyright is set out in a separate internal guide and is applied consistently whenever this happens.

14. Complaints

If you’re unhappy with any aspect of tuition, please email claire@ckchemistry.co.uk in the first instance — we aim to acknowledge complaints within 5 working days and to resolve them promptly and fairly. If a complaint relates to a safeguarding concern, please also see the reporting route in our Safeguarding Policy.

15. Changes to these terms

We may update these terms from time to time, for example as our services or the law change. We will post the current version on our website with its “last updated” date, and for group programme students already enrolled, we will give reasonable notice of any change that materially affects you before it takes effect.

16. Governing law

These terms are governed by the law of England and Wales, and any dispute will be dealt with by the courts of England and Wales.

1. What these terms cover

These terms apply whenever you buy or download a digital product from CK Chemistry, including predicted papers, practice question booklets, and the resource bank subscription, whether purchased through ckchemistry.co.uk or received as a free resource via a third-party platform such as TES (see Section 7). They sit alongside our Tuition Terms & Conditions, which cover live tuition itself.

2. The licence we grant you

When you buy a digital product, we grant the purchasing individual a personal, non-exclusive, non-transferable licence to download and use that product for their own study, or — where the purchaser is a teacher or tutor buying for their own teaching — for use with the students they personally teach. This licence does not transfer ownership or copyright, which remains with CK Chemistry at all times.

3. What you must not do

Unless we’ve agreed a school or bulk licence with you in writing (Section 4), you must not:

resell, sublicense, or otherwise charge others for access to the product or any part of it;
share, forward, upload, or redistribute the product — including via email, cloud storage links, messaging apps, group chats, forums, marketplaces (including TES, Vinehouse, Etsy or similar), or file-sharing sites — to anyone who has not purchased their own licence;
remove, crop, or obscure any watermark, name, branding, or licence notice from the product;
use the product to create a competing resource for sale or distribution.

These restrictions exist so that pricing stays fair to everyone who pays, and so we can keep producing new resources. We watermark digital products with the purchaser’s details and monitor for unauthorised sharing; see Section 9.

4. School and bulk licences

If you want to buy access for a class, department, or multiple students at once (for example, a set of predicted papers for a whole teaching group), please contact us for a school/bulk licence rather than buying a single-user licence and sharing it. Bulk licences are priced per cohort size and still do not permit redistribution beyond the students or staff covered by that licence.

5. Delivery

Digital products are delivered electronically — typically as an instant download or via access to our learning platform (Tutor LMS) — immediately or shortly after payment is confirmed.

6. Your right to cancel, and refunds

Because digital content, once downloaded, cannot practically be “returned”, UK consumer law treats it differently from a physical product. Before you complete a purchase, we will ask you to confirm that you understand that once you begin downloading or accessing the content, you lose your normal 14-day right to cancel for a change of mind. This does not affect your rights if a product is faulty, materially different from its description, or fails to download correctly — in that case, contact us at Claire@CKChemistry.co.uk and we will fix the fault, provide a working replacement, or refund you, as appropriate.

Resource bank subscriptions are billed monthly. You can cancel at any time via your account dashboard on our learning platform, effective at the end of the billing period already paid for — your access continues until then and you will not be billed again once you’ve cancelled. If you have any trouble cancelling through your dashboard, or would prefer us to do it for you, contact us at Claire@CKChemistry.co.uk and we’ll action it as quickly as possible.

7. Free resources (including on TES)

Where we make a resource available for free — including free resources published via TES or similar platforms for promotional purposes — it is still protected by copyright and provided under a limited personal-use licence on the same basis as Section 3: free to use for your own study or teaching, not to be resold, rebranded, or redistributed as if it were your own. We keep our paid content, including predicted papers and premium booklets, off third-party marketplaces specifically to keep proper control over how it’s licensed and shared.

8. Accuracy of predicted papers and resources

Predicted papers, mock materials and revision resources are prepared using professional judgement and exam-board pattern analysis, but they are our best estimate, not a guarantee of what will appear in any actual exam. We are not liable for exam outcomes based on reliance on these materials; they are intended as a revision and practice aid alongside, not instead of, full syllabus coverage.

9. Protecting our copyright

Our digital products may include a visible or embedded watermark identifying the purchaser, and we periodically monitor for unauthorised copies online. If we identify that a product has been shared or resold in breach of this licence, we will contact the person responsible and, where hosted on a third-party platform, request its removal; repeated or commercial-scale infringement may be pursued further, including for damages. If you become aware of one of our resources being shared or sold without permission, we’d be grateful if you let us know at Claire@CKChemistry.co.uk.

10. Liability

Nothing in these terms limits or excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited or excluded. Subject to that, our liability to you for a digital product is limited to the amount you paid for that product.

We may update these terms from time to time; the current version will always be available on our website with its “last updated” date.
